Welcome to Time Capsule Toys. These Terms and Conditions apply to purchases made through our website. By placing an order with us, you agree to these Terms and Conditions.
1. About Us
Time Capsule Toys is an independent UK toy and collectibles business based in Hampshire.
We specialise in vintage, pre-owned and modern toys, games, collectibles and memorabilia.

2. Our Products
We aim to describe and photograph all products as accurately as possible.
Many of the items sold by Time Capsule Toys are vintage, collectible or pre-owned. These items may show signs of age, previous use, storage or general wear.
Where reasonably possible, significant marks, damage, missing pieces or other known issues will be described in the product listing and/or shown in the photographs.
Please carefully review the product description and photographs before purchasing.
Colours may appear slightly different depending on your screen or device.
Unless specifically stated otherwise, only the items shown and described in the product listing are included in the sale.
3. Vintage and Pre-Owned Items
Due to the nature and age of vintage and pre-owned products, their condition may differ from that of a new product.
Original packaging may show signs of age, including fading, creasing, scuffs, tears, old price labels or other storage wear.
Where an item is sold as sealed or unopened, this refers to its apparent condition based on reasonable visual inspection. We cannot guarantee the internal condition of an item that has remained sealed for many years.
Vintage toys and collectibles may not meet modern toy safety standards. Products described or sold as collectors' items are intended for collection or display and may not be suitable for children or for play.
Please read any age recommendations, safety information and product descriptions carefully before purchase.
4. Prices and Payment
All prices are shown in pounds sterling (£).
The total price of your order, including any applicable delivery charges, will be shown before you complete your purchase.
Payment must be successfully completed before an order is dispatched.
We reserve the right to correct genuine pricing or listing errors. If an error affects an order you have already placed, we will contact you before proceeding and, where appropriate, offer you the option to cancel the order for a full refund.
5. Orders
After placing an order, you should receive an order confirmation.
An order may be cancelled by us if, for example:

the item is unexpectedly unavailable;

there has been a genuine pricing or listing error;

payment has not been successfully authorised; or
-
we are unable to fulfil the order for another reasonable reason.
If we cancel an order after payment has been taken, you will receive a full refund for the affected item or order.
6. Delivery
Available delivery options and charges will be displayed during checkout.
We aim to dispatch orders within 2 working days, unless otherwise stated on the product listing.
Delivery times provided by postal or courier services are estimates unless a specific guaranteed service has been agreed.
Please ensure that the delivery address supplied when ordering is correct.
We are responsible for the goods until they are delivered to you or to a person you have identified to receive them on your behalf.
If an order is lost or damaged during delivery, please contact us as soon as possible so that we can investigate and arrange an appropriate resolution.
7. Your Right to Cancel an Online Order
If you are purchasing as a consumer, you normally have the right to change your mind and cancel your online purchase within 14 days of receiving the goods, subject to any exceptions provided by law.
Certain items may be excluded from the right to cancel where an exception under UK consumer law applies. Any applicable exclusion will be made clear in the product listing where relevant.
You do not need to give us a reason for cancelling.
To exercise your right to cancel, you must clearly tell us that you wish to cancel within the 14-day cancellation period.
After notifying us, you normally have a further 14 days to return the goods.
Unless the item is faulty, damaged on arrival, incorrectly supplied or not as described, you will normally be responsible for the cost of returning it.
We recommend using a tracked or otherwise suitable postal service when returning valuable items.
8. Condition of Returned Items
You may inspect an item in the same way that you reasonably could in a physical shop.
If an item has been handled beyond what is reasonably necessary to establish its nature, characteristics and condition, and its value has consequently been reduced, we may make a deduction from the refund where permitted by law.
Where applicable, items should be returned with their original packaging, accessories and components.
This does not affect your statutory rights where an item is faulty or not as described.
9. Refunds
Where you validly cancel an online order under your statutory cancellation rights, we will refund the price paid for the goods and the cost of our standard delivery option, where applicable.
If you selected a more expensive delivery service, we are not required to refund the additional amount above our standard delivery charge.
Refunds will normally be made using the original payment method.
We may withhold the refund until we have received the returned goods or you provide evidence that you have sent them back, where permitted by law.
Refunds will be processed within the timescales required by UK consumer law.
10. Faulty, Damaged or Incorrect Items
We want our listings to accurately represent the item you receive.
If an item arrives damaged, is faulty, is not as described or you receive the wrong item, please contact us as soon as possible with your order details and, where helpful, photographs of the issue.
Your legal rights under the Consumer Rights Act 2015 are not affected by these Terms and Conditions.
Nothing in these Terms and Conditions limits or excludes any rights you have under UK consumer law.
11. Collectible Value
The value of vintage toys and collectibles can rise or fall over time.
Any reference to rarity, collectability or previous/current market value is provided for general information only.
Time Capsule Toys does not guarantee that an item will increase or retain its value and products should not be regarded as financial investments.
12. Authenticity and Product Information
We make reasonable efforts to correctly identify, describe and, where relevant, assess the authenticity of the items we sell.
Descriptions are based on the information reasonably available to us at the time of listing.
If we become aware that information in a listing is materially incorrect, we will take reasonable steps to correct it.
13. Intellectual Property
All original content created by Time Capsule Toys for this website, including our branding, logo, written descriptions, original photographs and graphics, belongs to Time Capsule Toys unless otherwise stated.
Any third-party trademarks, brand names, logos, characters or other intellectual property refered to or shown remail the property of their respective owners. Their use is solely to identify or describe genuine products offered for sale.
Time Capsule Toys is not affiliated with, sponsored by or endorsed by any third-party manufacturer or brand owner unless specifically stated.
14. Website Availability
We aim to keep our website accurate and available, but we cannot guarantee that it will always operate without interruption or technical errors.
We may update, change or remove website content where necessary.
15. Liability
Nothing in these Terms and Conditions excludes or limits liability where doing so would be unlawful.
We are not responsible for losses that were not reasonably foreseeable when the contract was formed or for losses arising from the use of products in a way that is contrary to their description, instructions, age guidance or intended purpose.
Nothing in this section affects your statutory consumer rights.
16. Personal Information
Personal information supplied when using our website or placing an order will be handled in accordance with our Privacy Policy and applicable UK data protection law.
17. Changes to These Terms
We may update these Terms and Conditions from time to time to reflect changes to our business, website or applicable law.
The Terms and Conditions applying to your purchase will be those in force when your order is placed.
18. Governing Law
These Terms and Conditions are governed by the laws of England and Wales.
If you are a consumer living elsewhere in the United Kingdom, you may also benefit from mandatory protections provided by the laws applicable where you live.
